Bienvenido a easycommand.es. Esta plataforma y sus servicios son propiedad y están operados por OptimaWeb LLC. Al acceder o utilizar nuestra plataforma web y aplicación móvil, aceptas quedar legalmente vinculado por los siguientes Términos y Condiciones. Si no estás de acuerdo con estos Términos, no debes utilizar el Servicio.
1. Descripción del Servicio
easycommand.es es una plataforma tecnológica que actúa como intermediario para conectar a los usuarios con los locales y establecimientos de comida registrados. El Servicio permite a los Clientes ver los menús, realizar pedidos de comida y bebida, y solicitar la cuenta. OptimaWeb LLC no es un local ni un proveedor de alimentos. No preparamos la comida, ni controlamos la calidad, seguridad o legalidad de los productos o servicios ofrecidos por los Locales. La responsabilidad de los productos, la preparación, la calidad y el servicio recae exclusivamente en el Local.
2. Cuentas de Usuario
Para utilizar ciertas funciones del Servicio, debes crear una cuenta. Te comprometes a proporcionar información precisa y completa. Eres el único responsable de mantener la confidencialidad de tu contraseña y de todas las actividades que ocurran bajo tu cuenta. Notifícanos inmediatamente cualquier uso no autorizado de tu cuenta.
3. Licencia de Usuario
Te otorgamos una licencia limitada, no exclusiva, intransferible y revocable para utilizar el Servicio únicamente para tus fines personales y no comerciales, de acuerdo con estos Términos.
4. Uso del Servicio
No puedes utilizar el Servicio para fines ilegales o no autorizados. Esto incluye, pero no se limita a:
- Violar leyes federales, estatales o locales de EE. UU.
- Cargar, publicar o transmitir virus, malware o cualquier otro código malicioso.
- Acosar, abusar o amenazar a otros usuarios o a los Locales.
- Interferir con la operación del Servicio o los servidores de easycommand.es.
- Suplantar a otra persona o entidad.
5. Pedidos y Pagos
a. Los precios de los productos y servicios se establecen por los Locales y pueden variar. b. La plataforma facilita la solicitud de la cuenta, pero el pago se realiza directamente entre el cliente y el local, utilizando los métodos de cobro disponibles en el establecimiento. easycommand.es no procesa ni gestiona los pagos de los clientes. c. Las políticas de cancelación y reembolso son establecidas por cada Local. easycommand.es no es responsable de procesar reembolsos ni de ninguna disputa relacionada con el pago.
6. Propiedad Intelectual
Todo el contenido del Servicio, incluyendo texto, gráficos, logotipos, iconos de botones, imágenes, audio, software y la compilación de dicho contenido, es propiedad de OptimaWeb LLC o de sus licenciantes y está protegido por las leyes de propiedad intelectual de EE. UU. y de otros países. Los Locales otorgan a OptimaWeb LLC una licencia no exclusiva para mostrar sus menús, logos e imágenes en la plataforma.
7. Descargos de Responsabilidad
el servicio se proporciona «tal cual» y «según disponibilidad». optimaweb llc no ofrece garantías de ningún tipo, expresas o implícitas, incluyendo, pero no limitado a, las garantías implícitas de comerciabilidad, idoneidad para un propósito particular y no infracción. optimaweb llc no garantiza que el servicio será ininterrumpido, libre de errores o seguro.
8. Limitación de Responsabilidad
en la medida máxima permitida por la ley, optimaweb llc no será responsable por daños indirectos, incidentales, especiales, consecuenciales o punitivos, incluyendo pérdida de ganancias, datos o fondo de comercio. nuestra responsabilidad total por cualquier reclamación derivada del uso del servicio no excederá los cien dólares ($100).
9. Ley Aplicable y Jurisdicción
Estos Términos se regirán e interpretarán de acuerdo con las leyes del Estado de en EE. UU.

Welcome to easycommand.es. This platform and its services are owned and operated by OptimaWeb LLC. By accessing or using our web platform and mobile application, you agree to be legally bound by the following Terms and Conditions. easycommand.es is a technology platform that acts as an intermediary to connect users with registered venues and food establishments. The Service allows Customers to view menus, place food and drink orders, and request the bill. OptimaWeb LLC is not a venue or food provider. We do not prepare food, nor do we control the quality, safety, or legality of the products or services offered by the Venues. The responsibility for the products, preparation, quality, and service lies exclusively with the Venue.
2. User Accounts
To use certain features of the Service, you must create an account. You agree to provide accurate and complete information. You are solely responsible for maintaining the confidentiality of your password and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.
3. User License
We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service solely for your personal and non-commercial purposes, in accordance with these Terms.
4. Use of the Service
You may not use the Service for illegal or unauthorized purposes. This includes, but is not limited to:
- Violating federal, state, or local laws of the U.S.
- Uploading, publishing, or transmitting viruses, malware, or any other malicious code.
- Harassing, abusing, or threatening other users or Venues.
- Interfering with the operation of the Service or the servers of easycommand.es.
- Impersonating another person or entity.
5. Orders and Payments
a. The prices of products and services are set by the Venues and may vary. b. The platform facilitates the bill request, but payment is made directly between the customer and the venue, using the collection methods available at the establishment. easycommand.es does not process or manage customer payments. c. Cancellation and refund policies are established by each Venue. easycommand.es is not responsible for processing refunds or any payment-related disputes.
6. Intellectual Property
All content of the Service, including text, graphics, logos, button icons, images, audio, software, and the compilation of such content, is the property of OptimaWeb LLC or its licensors and is protected by intellectual property laws of the U.S. and other countries. The Venues grant OptimaWeb LLC a non-exclusive license to display their menus, logos, and images on the platform.
7. Disclaimers
the service is provided «as is» and «as available». optimaweb llc makes no warranties of any kind, express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. optimaweb llc does not guarantee that the service will be uninterrupted, error-free, or secure.
8. Limitación de Responsabilidad
to the maximum extent permitted by law, optimaweb llc will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. our total liability for any claim arising from the use of the service will not exceed one hundred dollars ($100).

These Terms will be governed by and construed in accordance with the laws of the State of in the U.S.
